BIOGRAPHICAL INFORMATION:
CHRISTINA SILVA is a Member of the Firm of Lum, Drasco & Positan, LLC, where she specializes in employment law matters litigated on behalf of management, including whistleblower claims and matters involving harassment, discrimination, retaliation, wrongful discharge, breach of contract and restrictive covenants; with litigation and advocacy experience in State and Federal Court, the Equal Employment Opportunity Commission and the New Jersey Division on Civil Rights. She also concentrates her practice in the area of employment counseling, including the drafting and preparation of personnel policies, employment handbooks, employment and confidentiality agreements, non-competition clauses, leave provisions, and severance and separation agreements. Her practice also includes the conducting of workplace investigations, and the training of corporate clients on employee hiring practices, anti-harassment and personnel policies, company complaint mechanisms and investigations.
As a member of the NJSBA Labor and Employment and Litigation Sections, she acts as liaison between the Labor and Employment Section Executive Committee and Hispanic Bar Association. Also a member of the Labor and Employment and Litigation Section of the ABA, she previously served as Co-Chair and Vice-Chair of the Labor and Employment Law Committee of the Essex County Bar Association. A graduate of the Arthur T. Vanderbilt Inn of Court, she co-authored an article entitled "Free Speech in the Workplace" for the ABA Section of Litigation, and has served on the Editorial Board of the NJSBA Labor and Employment Quarterly as an Articles Editor since 1995. She has also frequently lectured at NJSBA and ICLE programs on harassment and discrimination litigation, and anti-harassment discrimination training and investigations in the workplace. She is currently the co-Corporate Secretary and co-Director of the Best Practices Committee for the New Jersey Women Lawyers Association.
She is a former judicial clerk to the Honorable B. Theodore Bozonelis, Superior Court of New Jersey, Law Division, Morris County, and is admitted to practice in New Jersey and in the United States District Court of New Jersey. She received her J.D. degree from Seton Hall University School of Law in 1993, and her B.A. in English and Communications from Villanova University in 1990.
